Proposed Assumption of Risk & Liability Waiver

There is always an inherent risk in attending any event or participating in any activity. Due to the circumstances created by the COVID-19 pandemic, there is a heightened degree of personal risk and responsibility in attending a live event. Teriyaki Madness Franchising (“TMAD”), the Grand Hyatt Vail  (“Hotel”), Vendors, and Contractors will follow health authority guidelines and implement preventative measures to mitigate the spread of COVID-19. However, TMAD cannot guarantee that you will not become infected with COVID-19 when participating in the Franchise Owners Conference (“Event”).

By registering for the Franchise Owners Conference AND/OR having a badge printed to access the Event:

1. A) I voluntarily acknowledge and assume the risks associated with potentially being exposed to COVID-19 by attending and participating in the Franchise Owners Conference and that such exposure or infection may result in personal injury, illness, permanent disability, and death. I understand that the risk of becoming exposed to or infected by COVID-19 at the Event may result from the actions, omissions, or negligence of myself and others, including, but not limited to, TMAD employees, contractors, volunteers, and program participants and their families.
2. B) I acknowledge and affirm that I agree to abide by all health safety rules and precautions provided to me by Event staff, including but not limited to complying with health screening, and, when required, maintaining social distancing, wearing a face covering, frequently washing/sanitizing my hands, and respecting the social distancing indicators worn by other attendees.
3. C) I voluntarily agree to assume all of the foregoing risks and accept sole responsibility for any injury to myself (including, but not limited to, personal injury, disability, illness and death), damage, loss, claim, liability, or expense, of any kind, that I may experience or incur in connection with my attendance at the Event (“Claims”).

On my behalf, and on behalf of my heirs, successors, assigns, and personal representatives, I hereby release, covenant not to sue, discharge, and hold harmless TMAD, Hotel, their affiliates, and their respective officers, directors, employees, agents, volunteers, and representatives (“Released Parties”) of and from the Claims, including all liabilities, claims, actions, damages, costs or expenses of any kind arising out of or relating thereto. I understand and agree that this release includes any Claims based on the actions, omissions, or negligence of the Released Parties, whether a COVID-19 infection occurs before, during, or after participation in any TMAD Event and in any role (e.g. employee, contractor, vendor, attendee, participant, service provider, etc.)
